Welcome to Bros D App, operated by Services by AOUT-18 TECHNOLOGIES LTD (“Bros D,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our mobile application, websites (www.bros-d.com, www.aout18.com), and related services (collectively, “the Services”).
By using Bros D App, you agree to be bound by these Terms. If you do not agree, please discontinue using our Services.

You may only use Bros D App if you:

Notify us immediately of any unauthorized account activity.
Accept full responsibility for all activities under your account.

5. Vendor and Service Provider Obligations
If you register as a vendor, artisan, or service provider:
You represent that your goods or services are lawful, accurately described, and free from defects.
You are solely responsible for fulfillment, quality control, delivery, and customer service.
You must comply with all regulatory, licensing, tax, and legal obligations in your jurisdiction.
You grant Bros D App a limited license to display your business information, products, and service offerings.
Bros D App acts solely as an intermediary and does not guarantee vendor performance.
6. Payments
Bros D App facilitates secure online payments via third-party processors.
All prices, fees, commissions, or charges are clearly stated before transactions are confirmed.
You authorize us to process payments and disbursements in accordance with our payment policies.
Refunds, cancellations, and disputes are governed by applicable refund policies, vendor policies, or the law.
Bros D App is not a financial institution or payment processor.
7. Delivery and Fulfillment
Delivery timelines are estimates and may vary based on location, product/service availability, and logistics.
Vendors are solely responsible for fulfillment.
Bros D App may facilitate third-party delivery but does not guarantee delivery times.
8. Acceptable Use
You agree not to:
Violate any laws, regulations, or these Terms.
Post false, misleading, or fraudulent information.
Engage in harassment, abuse, discrimination, or offensive conduct.
Interfere with platform operations, security, or networks.
Upload harmful software, malware, or unauthorized advertising.
We reserve the right to remove any content or suspend accounts violating these terms.
9. Intellectual Property
Bros D App, including its content, trademarks, logos, software, and systems, is owned by SERVICES BY AOUT-18 TECHNOLOGIES LTD and protected under copyright and intellectual property laws.
Users may not copy, reproduce, distribute, or reverse-engineer any portion of the Services without prior written consent.
You retain ownership of content you upload but grant Bros D App a non-exclusive, royalty-free license to display and promote it on the platform.

11. Disclaimers
Bros D App provides the Services on an “as-is” and “as-available” basis.
We do not guarantee uninterrupted or error-free operation.
We do not guarantee the accuracy, quality, legality, or safety of any vendor goods or services.
Users engage vendors, artisans, and delivery providers at their own risk.
We disclaim all warranties to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, Bros D App and SERVICES BY AOUT-18 TECHNOLOGIES LTD shall not be liable for:
Any indirect, incidental, special, or consequential damages.
Loss of profits, data, or business opportunities.
Unauthorized access or use of your data or account.
Vendor, delivery, or customer disputes.
Our total aggregate liability shall not exceed the greater of NGN 50,000 or amounts paid by you in the preceding 6 months.
13. Indemnification
You agree to indemnify and hold harmless Bros D App, SERVICES BY AOUT-18 TECHNOLOGIES LTD, our officers, affiliates, and partners from any claims, losses, damages, or expenses (including legal fees) arising from:
Your use of the Services.
Your violation of these Terms.
Your interactions with vendors, artisans, or third parties.

15. Suspension and Termination
We reserve the right to suspend or terminate your access to Bros D App:
For violation of these Terms.
If required by law or regulatory authorities.
If we suspect fraud, abuse, or illegal activity.
Termination does not relieve you of any payment obligations or accrued liabilities.
16. Dispute Resolution
In the event of any dispute, parties agree to first attempt amicable settlement. If unresolved:
Governing Law: These Terms are governed by the laws of the Federal Republic of Nigeria.
Jurisdiction: Disputes may be submitted to the exclusive jurisdiction of competent Nigerian courts and firstly through ADR (Mediation)
Nothing herein limits consumer rights under applicable laws in Nigeria.

We may update these Terms from time to time. Continued use of Bros D App after changes take effect constitutes acceptance of the updated Terms. We will notify you of material changes through in-app notices, emails, or website updates.
